Tenants & Condominium owners

Who can use the charging stations?

The tenants of the property. The charging stations can also be activated for guests if desired. When moving in, the tenant can be granted access to the charging station with a simple click. When moving out, the access can be just as easily revoked.

How does billing work for tenants?

Tenants register with Swisscharge as customers. At the end of the month, the total charging amount is charged to the stored credit card. The property management periodically receives the revenue.

What do I need to consider as a tenant?

  • You need the consent of the landlord or their representative, usually a property management, for the installation of a charging infrastructure.
  • The regular use of communal electricity for charging is not contractually regulated in most cases. You need consent not only for the installation of the charging infrastructure but also for the electricity consumption.
  • It is recommended to bill the electricity via an intelligent charging station with an integrated meter.
  • In principle, you have no right to the development of a parking space or the regular use of an existing charging infrastructure if this is not agreed upon (Art. 256 OR). However, if you are willing to bear the costs wholly or partially, a solution can usually be found.
  • Under these circumstances, the property management is likely to be willing to waive the restoration of the previous condition at the end of the rental period. It is advisable to agree on this in writing (Art. 260a Abs. 2 OR). When ordering the charging station from Swisscharge, we are happy to provide you with a sample contract.
  • It is helpful to present a technical dossier of the charging infrastructure to the landlord or property management. Indicate the capacity (in kW) of the charging infrastructure.
  • It is recommended to clarify the possibility and necessity of load management with the supplier or installer and a building electrical specialist. This exchange usually takes place when the installation order is placed.

What do I need to consider as a condominium owner?

  • In condominium ownership, parking spaces, unlike enclosed garage boxes, are usually not allocated as special rights. Therefore, you need the consent of the owners' meeting for the installation of a charging infrastructure.
  • The development of garage spaces with electricity is likely to be seen as a "necessary measure" given the growing importance of electromobility. Consequently, you need a majority decision from the owners. You base this on Art. 647c ZGB.
  • If the installation of the charging infrastructure is only considered a "useful measure," you need a majority decision from the owners who also hold the majority of the value of the property (value quota). You base this on the Federal Court decision 5C.110/2001.
  • A structural change that is only in the interest of an individual condominium owner can also be considered "useful" in this sense and therefore requires only a majority decision from the owners who also hold the majority of the value of the property.
  • If you, as an individual, plan to install a charging infrastructure, you will likely only achieve the majority decision by covering the development costs. This is also provided for by law (Art. 712h Abs. 3 ZGB).
  • If other condominium owners wish to install charging infrastructures at a later date, it is only fair that they contribute to the initial costs you have borne. A corresponding regulation is recommended when creating the first charging infrastructure.
  • If the development of garages allocated as special rights requires structural measures on communal components, the other condominium owners must tolerate the necessary routing of cables against compensation (Art. 691 ZGB).
  • It is helpful to present a technical dossier of the charging infrastructure to the owners' meeting. Indicate the capacity (in kW) of the charging infrastructure. Request the necessary documents from the supplier or installer of your charging infrastructure.
  • Prepare an application with justification and applicable agreements and regulations for the owners' meeting.
  • Ensure that any agreed regulations are transferred to the new owner in the event of a sale of the apartment or property.
  • Ask your electric car dealer for a "Home Check." This will determine the best charging solution for your vehicle.
  • It is recommended to clarify the possibility and necessity of load management with the supplier or installer and the building electrical specialist. This exchange usually takes place when the installation order is placed.
