Swisscharge Privacy Policy

Protecting your privacy is important to us. We are committed to transparent handling of your data. Below, we explain which personal data is stored when using this website and how it is handled. We also show you how you can unsubscribe from third-party services that we use.

Swisscharge Respects Your Privacy

Protecting your privacy when processing personal data and the security of all business data is an important concern for us, which we take into account in our business processes. We process personal data collected during your visit to our online offerings confidentially and only in accordance with legal regulations.

For the processing of data from visitors from Switzerland and countries outside the EU, only Swiss law is applicable, namely the Federal Act on Data Protection (FADP, SR 235.1) and the corresponding Ordinance to the Federal Act on Data Protection (SR 235.11). The EU General Data Protection Regulation (GDPR) does not apply unless expressly provided for in this privacy policy or if the GDPR would be mandatorily applicable to data from visitors from Switzerland and countries outside the EU due to special conditions.

For the processing of data from visitors from the EU area, the Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data, on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, GDPR) is additionally applicable.

Purpose of the Website

The website provides general information about Swisscharge as well as products, offers, and career opportunities.

General Information on the Collection, Processing, and Use of Personal Data

Personal data is any information relating to an identified or identifiable natural person, such as names, addresses, phone numbers, or email addresses, which are an expression of a person's identity.

We collect, process, and use personal data (including IP addresses) only when necessary for the fulfillment of a contract or for carrying out pre-contractual measures or when processing is necessary to protect our legitimate interests.

  • Contact data such as name, phone number, email addresses, address, date of birth
  • Communication data such as your IP address, MAC addresses of devices used like smartphones or computers, device and settings information
  • Data on purchase history such as purchase data including information on purchased products
  • Other personal data, such as credit card data, bank details, and career information

Log Files

Every time the internet is used, certain information is automatically transmitted by your internet browser and stored by us in so-called log files.

The log files are stored by us for the purpose of identifying disruptions and for security reasons (e.g., to clarify attempted attacks) as long as necessary for these purposes and then deleted or anonymized. Log files that need to be retained as evidence are excluded from deletion until the respective incident is finally clarified and may be passed on to investigative authorities in individual cases. The storage of log files serves our legitimate interests in the trouble-free and correct operation of our website.

The following information is stored in the log files in particular:

  • IP address (Internet Protocol address) of the device from which the online offer is accessed;
  • Internet address of the website from which the online offer was accessed (so-called origin or referrer URL);
  • Name of the service provider through which access to the online offer is made;
  • Name of the retrieved files or information;
  • Date and time as well as duration of the retrieval;
  • Transferred data volume;
  • Operating system and information about the internet browser used including installed add-ons (e.g., for a password manager);
  • HTTP status code (e.g., "request successful" or "requested file not found").

User Analysis

On the website swisscharge.ch , analysis tools (e.g., Google Analytics) are used. The information collected about the use of the websites is stored on the servers of the tool providers and also combined in Snowflake with data from the ERP and POS system for evaluation purposes.

With the help of the analysis tools, we are able to collect and analyze data about the use of our website by visitors. This allows us to find out when and from which region which page views were made.

Other data collected would include, for example, file names of accessed files, browsers used, functions used, or the time spent on the website.

Swisscharge has a legitimate interest in the anonymized analysis of user behavior to optimize both the web offering and advertising. If prior consent was requested during your visit to our website (e.g., consent to store cookies), processing is based on your consent, which you can revoke at any time for the future.

Detailed information about the analysis tools used can be found in our Cookie Policy .

Data Sharing

Your personal data will only be transmitted to other controllers to the extent necessary for contract fulfillment, we or the third party have an overriding legitimate interest in the transmission, or your consent is given.

In addition, data may be transmitted to other controllers if we are obliged to do so due to legal regulations or enforceable official or court orders.

Service Providers

We commission external service providers with tasks such as marketing services, development operations, data hosting, shipping, and debugging. We carefully select these service providers and regularly monitor them, especially their careful handling of and securing of the data stored with them. All service providers are obligated by us to maintain confidentiality and comply with legal requirements.

Transfer to Recipients Outside the EEA

We may also transfer personal data to recipients located outside the EEA in so-called third countries. In this case, we ensure before the transfer that an adequate level of data protection exists at the recipient through appropriate contractual agreements or, if necessary, that your consent to the transfer is given.

Information on Data Storage: Storage Location & Retention Periods

Your data is primarily stored in Switzerland and Germany. Due to various service providers, data is also stored in other EU countries and within the USA.

We generally store your data as long as it is necessary to provide our services and related services, or we have a legitimate interest in further storage (e.g., we may have a legitimate interest in postal marketing even after fulfilling a contract). After that, we delete your personal data, except for data that we must continue to store to fulfill legal obligations (e.g., due to tax and commercial retention periods, we are required to keep documents such as contracts and invoices for a certain period).

Marketing Tools

We use various tools for marketing activities. When using these tools, your browser partially establishes a direct connection to the servers of the respective tools. This allows the respective provider to receive information that your browser has accessed the corresponding page of our offer. Log files similar to those described in point 5 are also transmitted to the servers of the respective providers and may be stored there. The provider or its server may be located outside of Switzerland or the EU or EEA (e.g., in the USA).

Data exchange takes place via third-party cookies.

Further information on the purpose, scope, further processing, and use of the data can be found in our Cookie Policy and in the respective terms and conditions and data protection notices.

Newsletter

Your email address, which you provided when signing up for the newsletter or registering a customer account, is used to send you information about our offer. You can object to this use at any time by clicking on the unsubscribe link in the email.

Security

Our employees and the service providers we commission are obliged to maintain confidentiality and comply with the provisions of applicable data protection laws.

We take all necessary technical and organizational measures to ensure an appropriate level of protection and to protect the data we manage from the risks of accidental or unlawful destruction, manipulation, loss, alteration, or unauthorized disclosure or access.

Your Rights

Please use the information in the "Contact Information" section to exercise your rights. Please ensure that we can clearly identify you.

Right to Information and Access

You have the right to receive information from us about the processing of your data. To this end, you can exercise a right of access regarding the personal data we process about you.

The data will be provided to you within 20 working days after receipt of your request.

Right to Rectification and Erasure

You can request the correction of incorrect data from us. If the legal requirements are met, you can request the completion or deletion of your data.

Please contact us in writing or by phone to request the deletion of your data. You can find the contact information under Contact on this page.

This does not apply to data required for billing and accounting purposes or subject to legal retention obligations.

The deletion of the data will be completed within 20 working days after receipt of your request.

Data Portability

If the legal requirements are met, you can request that data you have provided to us be transmitted in a structured, commonly used, and machine-readable format, or – if technically feasible – that the data be transmitted to a third party.

Right to Object

Objection to Direct Marketing

You can also object to the processing of your personal data for advertising purposes at any time ("advertising objection"). Please note that there may be an overlap between your objection and the use of your data in an ongoing campaign for organizational reasons.

Objection to Data Processing on the Legal Basis of "Legitimate Interest"

In addition, you have the right to object to data processing by us at any time, provided it is based on the legal basis of "legitimate interest." We will then stop processing your data unless we can demonstrate compelling legitimate grounds for further processing that outweigh your rights, in accordance with legal requirements.

Withdrawal of Consent

If you have given us consent to process your data, you can withdraw it at any time with effect for the future. The lawfulness of the processing of your data until the withdrawal remains unaffected.

Changes to the Privacy Policy

We reserve the right to adjust our security and data protection measures. In such cases, we will also adapt our privacy policy accordingly.
